Terminating an Employee

Tell the individual in person.

Make sure that more than one person is present for the termination meeting. Make sure to have a witness in the case the substance of the meeting becomes an issue in litigation.

Take notes during the termination meeting.

Make the reasons for the termination clear.

Avoid problems. Don’t create risk of liability for defamation by calling an employee an incompetent or a thief.

Let the employee talk. Give to the employee the opportunity to tell his side of the story.

Make sure that the terminated employee timely receives all benefits (vested vacation pay, commissions).

Explain what will happen about their pension plan.
